These Terms of Use (“Terms”) form a legal agreement between you (“you” or “User”) and OWN PLACE LLC (“we,” “us,” or “our”), a Washington limited liability company located at 7707 NE 141st St, Kirkland, WA 98034-5321, USA (contact@ownplace.net; telephone +1 (213) 524-8012), and govern your use of the Talefall — Audiobook Player application (the “App”; bundle identifier com.anisimov.audiobooks) and the optional AI Studio service reached through it (the “Service”).
How you accept these Terms. By downloading, installing, or using the App, you agree to these Terms as they apply to the player. Before first use of AI Studio, the App presents the Terms screen. Before the first writing-mode order, and again if the provider changes, the App separately asks permission to send writing-mode content to OpenRouter and Meta. Server-based narration does not require permission to send content to OpenRouter or Meta because it is not sent to them (Section 5.1). Before every order you also confirm that the order contains no information about an identifiable real person and no sensitive personal data, and before every server-based narration order you confirm the upload to our service on Modal (Section 5.1). We record the Terms version, acceptance date, and the subscription transaction identifier used for the Service. If you do not agree, do not use the App or the Service.

1. The App and the Service
The App is a native iOS audiobook player. It lets you import your own audio files (MP3, M4A, M4B, AAC, FLAC, and other formats converted on the device) and text books (EPUB, FB2, PDF, TXT), and listen or read with features including saved position, variable speed, sleep timer, bookmarks, chapter navigation, background and lock-screen playback, AirPlay output, listening statistics, Siri Shortcuts, an on-device reader with highlights and notes, on-device speech-to-text, and reading aloud with an on-device Apple voice. The App also provides access to built-in catalogs of audiobooks and texts identified by LibriVox, the Internet Archive, and Project Gutenberg as public-domain or otherwise lawfully available. Each catalog integration is used subject to the provider’s applicable API, linking, attribution, and content-access terms. We may remove an integration or item if the provider’s terms or the work’s legal status do not permit access through the App. The player has no user accounts. The player does not upload your library automatically. Text you explicitly submit for AI Studio narration, and content you choose to include in a report or support request, are exceptions described in our Privacy Policy.
The Service (AI Studio) is an optional, paid feature with two modes. In writing mode, our server writes an original work of fiction from your description using a large language model and reads it aloud in our narrator voice. In server-based narration mode, it reads aloud a text book you already have. The result is delivered to the App. AI Studio’s writing mode is intended solely to generate fictional entertainment. The server-based narration mode may process only text that you are legally entitled to submit and that does not contain personal or consumer health data about an identifiable real person, including you. Use the on-device voice for text containing such data. The Service is provided by OWN PLACE LLC on rented cloud infrastructure, is available only with an active AI Studio subscription (Section 4), and only in Supported Territories (Section 4.9).
2. License to Use the App; Age Requirement
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the Apple Media Services Terms and Conditions (the “Usage Rules”). Your use of the App is also governed by Apple’s standard Licensed Application End User License Agreement (Apple Standard EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. In case of conflict between these Terms and the Apple Standard EULA, the Apple Standard EULA controls with respect to Apple’s required minimum terms.
Age requirement. The App is rated 18+ on the App Store. That rating applies to the App as a whole, because AI Studio can generate text and narration that we do not review before it reaches you (Section 5); the player by itself does not produce adult content. By using the App — including the player — you represent that you are at least 18 years old, or the age of majority in your jurisdiction if that is older. Before your first AI Studio order the App asks you to confirm this. If you are under that age, do not download, install, or use the App, and a parent or guardian may not use the App on a minor’s behalf.
3. The Player: One-Time Purchase, Evaluation Period, and Refunds
- The App is free to download and includes a 3-day free evaluation period. You will not be charged automatically when the evaluation period ends. Evaluation periods that began under an earlier version of the App keep the length granted at that time (previously 14 days); a change to the evaluation period never shortens one already running.
- To continue using the player’s full functionality after the evaluation
period, you must complete a one-time non-consumable purchase through
Apple (product
com.anisimov.audiobooks.pro). The price is the localized price displayed by Apple immediately before purchase; any example price on our website is illustrative and may be outdated. This is not a subscription, and there are no recurring charges for the player. A user who purchases the player’s current non-consumable entitlement will retain the player functionality covered by that entitlement, subject to technical compatibility, the Apple Standard EULA, and applicable law. - The evaluation period is tracked locally; the start date is stored in the iOS Keychain and iCloud Key-Value Store so that reinstalling does not restart it.
- The player purchase does not include AI Studio, and an AI Studio subscription does not include the player purchase; they are separate products.
4. AI Studio: Subscription, Hours, Extra Hours, and Cancellation
4.1 Subscription. AI Studio requires an auto-renewable monthly
subscription purchased through Apple (product
com.anisimov.audiobooks.generation.monthly). The price is the localized
price displayed by Apple immediately before purchase; any example price on
our website is illustrative and may be outdated. Before the system purchase
sheet, the App shows the subscription name, its duration, the localized
price, the hours included, the expiry of unused monthly hours, that the
subscription renews automatically, how to cancel, and links to these Terms
and the Privacy Policy. Payment is charged to your Apple Account at
confirmation of purchase. The subscription renews automatically for the
same period at the same price unless you turn off auto-renewal at least 24
hours before the end of the current period; your Apple Account is charged for
renewal within 24 hours before the end of the current period. You can manage
or cancel the subscription in iOS Settings → Apple Account → Subscriptions.
Cancellation takes effect at the end of the current paid period. AI Studio
requires physical presence in a Supported Territory. Purchases also require
availability in the current App Store storefront. These checks apply to new
subscriptions, top-ups, and Service requests. An existing subscription may
continue to renew through Apple while you are outside a Supported Territory
unless you cancel it; unused monthly hours still expire. Except where
required by law, cancellation does not provide a prorated refund for a period
in which the Service remained available as promised. This does not limit
remedies for non-conforming, unavailable, or undelivered digital services.
App Store refunds are processed by Apple (Section 4.5).
4.2 Monthly hours and how they are charged. Each subscription period includes 10 hours of finished audio (“hours”). Before starting an order, the Service checks that the length you selected fits your remaining hours; if it does not, the order is refused before any work is done and the App tells you how many hours remain and when they renew. We charge the lesser of (a) the usable audio actually delivered and (b) the duration you selected when placing the order. Failed, canceled, duplicate, corrupted, or technically unusable output is not charged; hours reserved for such an order are restored to your balance automatically. If an order fails or is cancelled after the monthly period from which its hours were charged has ended, the restored hours are credited to your non-expiring extra-hours balance. If a charged file cannot be played or materially fails to contain the requested narration, we will restore the affected hours after verification — write to contact@ownplace.net with the book identifier shown in the App. “Delivery is confirmed only after the App has durably saved every chapter on the device.” A successful network transfer is not by itself delivery. “If full delivery is not confirmed within seven days after the Service accepts the order, we treat the order as failed, stop further processing, delete all server-side order content, and automatically restore all hours reserved or charged for that order. Chapters already saved on your device remain available.” Unused monthly hours expire at renewal and do not carry over, including while the subscriber is temporarily located outside the Supported Territories (Section 4.9). The monthly period follows your subscription’s renewal date, not the calendar month.
4.3 Extra hours. When you run out, you may either wait for renewal or buy
an extra-hours pack (product com.anisimov.audiobooks.hours5, 5
hours, a one-time consumable purchase at the localized price displayed by
Apple). Extra hours require an active AI Studio subscription to purchase and
are used only after the monthly hours are exhausted.
How crediting works. Apple may charge your Apple Account when it approves the purchase. We credit the five hours only after our server verifies the signed Apple transaction. If verification or delivery is temporarily unavailable, the App keeps the transaction pending and retries automatically. We will never credit the same transaction twice. If the hours are not credited within 24 hours, contact contact@ownplace.net; we will either restore the credit or help you request a refund from Apple.
What happens to extra hours later. Extra hours do not expire at renewal and do not expire solely because the subscription lapses or renews. If your subscription expires, unused extra hours become unavailable but remain recorded and become available again if the same subscription is reactivated. Unused extra hours also remain recorded while you are located outside the Supported Territories (Section 4.9). If we permanently discontinue AI Studio, we will provide a reasonable redemption period and, where redemption is impossible, assist affected users in requesting an appropriate refund through Apple (Section 8). Extra hours are not transferable to another subscription or Apple Account. Deleting content or consumer health data does not forfeit purchased extra hours. We retain only the minimum entitlement record needed to preserve that balance. If you request deletion of every identifier-linked record and preservation is technically impossible, we will first offer a refund path or obtain your separate confirmation of deletion and forfeiture.
4.4 Fair use and service limits. To protect the Service from abuse and runaway costs, we apply technical ceilings in addition to your hours: a maximum number of orders per day per subscription, a maximum order length (currently 15 minutes to 10 hours per book), size limits on submitted text, and a daily ceiling on total Service output across all users. If a ceiling is reached, the Service declines the order and asks you to try again later; declined orders consume no hours.
4.5 Refunds and billing questions. All purchases are processed by Apple through the App Store. OWN PLACE LLC does not receive or store your payment details or Apple Account credentials. Questions about charges, receipts, refunds, or purchase history should be directed to Apple Support (https://support.apple.com/billing, https://reportaproblem.apple.com); refunds are granted or denied by Apple under Apple’s policies. Nothing in these Terms limits any refund or remedy you are entitled to under applicable law for a non-conforming, unavailable, or undelivered digital service. If Apple refunds or revokes an AI Studio subscription, Apple notifies our server and the Service stops accepting new orders under that subscription immediately. Books already delivered to your device are not removed.
4.6 Restore Purchases. “Restore Purchases” in the App uses the Apple Account associated with the original purchase. If a completed purchase is not recognized after using Restore Purchases, contact us at contact@ownplace.net — that is a technical issue with the App, and we will help.
4.7 Price changes. Apple will notify you of any subscription price increase in advance and, where required, ask for your consent before the new price applies.
4.8 Sandbox and test builds. Purchases made in Apple’s sandbox environment or under TestFlight are for testing only and confer no rights to the production Service.
4.9 Territorial availability. The App is distributed only through the App Store storefronts in which OWN PLACE LLC makes it available. It is not distributed on storefronts in the European Economic Area, the United Kingdom, or Switzerland. After download, the player may continue to function while the device is elsewhere, subject to these Terms and applicable law. AI Studio, its auto-renewable subscription, extra-hours purchases, and all server-based writing and narration functions are offered only to persons physically located in a country or region identified as supported in the App and at https://ownplace.net/talefall/ai-studio-territories (a “Supported Territory”).
Outside the Supported Territories. AI Studio is not offered to persons located in the European Economic Area, the United Kingdom or Switzerland, nor to persons located in any other territory not identified as a Supported Territory, regardless of citizenship, residence, or the country or region of the person’s Apple Account. App Store storefront availability is a purchase control and is not confirmation that a person is legally eligible to use the Service.
By purchasing or submitting an AI Studio request, you represent that you are physically located in a Supported Territory. You must not use a VPN, change an App Store storefront, use another person’s Apple Account, or take any other step to circumvent a territorial restriction.
We may use the current App Store storefront and country-level location inferred from the request IP address to enforce this Section. We do not infer the U.S. state or any other sub-national region from the IP address, except to identify the sanctioned regions described below. We may refuse a purchase, top-up, or Service request if either indicates an unsupported territory. A refused Service request consumes no hours.
A subscription purchased in a Supported Territory does not authorize new AI Studio requests while you are physically located outside the Supported Territories. During that time, the local player and books already downloaded to your device remain available, and unused extra hours remain recorded for later use from a Supported Territory.
AI Studio requires physical presence in a Supported Territory. Purchases also require availability in the current App Store storefront. These checks apply to new subscriptions, top-ups, and Service requests. An existing subscription may continue to renew through Apple while you are outside a Supported Territory unless you cancel it; unused monthly hours still expire.
Unused monthly hours expire at renewal, including while the subscriber is temporarily located outside the Supported Territories. If we remove the territory in which a subscriber purchased and ordinarily uses AI Studio, we will provide cancellation instructions and assist with an Apple refund request for any materially unusable paid period.
Sanctioned regions within a Supported Territory. Independently of the country check, our service refuses requests originating from the Crimea region and the so-called Donetsk People’s Republic and Luhansk People’s Republic regions of Ukraine, as defined by OFAC, and any other region later designated as a Covered Region, even though Ukraine is a Supported Territory. Section 7 (Export and sanctions) applies in addition to this Section.
If the App cannot load the products. The App shows the AI Studio purchase screen only after the App Store returns the AI Studio products for your storefront. If the App Store returns no products for your storefront, the App shows “AI Studio is not offered in your App Store country or region” and does not offer a purchase. If the App Store does not answer within a short timeout, the App shows “Unable to load AI Studio purchases. Check your connection and try again.” with a retry option.
Territorial availability may change when required by law, regulation, a service-provider restriction, or an App Store requirement. We will provide advance notice where reasonably practicable. Nothing in this Section limits any refund or consumer right that cannot lawfully be excluded.
4.10 No reduction of what you already paid for. We will not reduce the hours or other material benefits already purchased for the current billing period. Material adverse changes to the Service apply only to future billing periods after reasonable advance notice. Where required by law, affected users may cancel and obtain the remedies provided by applicable consumer law.
5. AI-Generated Content
5.1 How it works; what you confirm before ordering. When you order a book in writing mode, your description is sent to our server, which uses a third-party large language model (currently reached through OpenRouter, with the model currently provided by Meta, in the United States) to write the text, and our own narration model to read it aloud. “OpenRouter and Meta process writing-mode content to generate the requested text. Requests are sent using a setting that restricts routing to providers that state they do not use content for training or routine retention. This is not a zero-retention guarantee; limited retention may occur for abuse prevention, security, billing, or legal compliance.” That routing setting operates fail-closed: if no provider with such a policy is available, the order is not sent. In server-based narration mode, the text is processed by our narrator model on infrastructure hosted by Modal and is not sent to OpenRouter, Meta, or another model provider (Section 5.8). Generation is automated. Authorized personnel do not routinely read content; limited review may occur when you request support, report content, submit a legal complaint, or when reasonably necessary to investigate abuse, security incidents, or comply with law.
Before first use of AI Studio, the App presents the Terms screen. Before the first writing-mode order, and again if the provider changes, the App separately asks permission to send writing-mode content to OpenRouter and Meta. Server-based narration does not require permission to send content to OpenRouter or Meta because it is not sent to them. Nothing is sent to an AI provider until you have granted that permission.
- Terms screen (“I Agree”), before first use of AI Studio. You accept these Terms, acknowledge the Privacy Policy, confirm that you are at least 18, and confirm the rule in Section 1: AI Studio’s writing mode is intended solely to generate fictional entertainment; the server-based narration mode may process only text that you are legally entitled to submit and that does not contain personal or consumer health data about an identifiable real person, including you.
- AI-provider permission screen (“Allow and Continue”), before the first writing-mode order and again if the provider changes, which states: “Allow content from my AI Studio writing-mode orders to be sent to OpenRouter and Meta in the United States until I withdraw this permission or the provider changes. OpenRouter and Meta process writing-mode content to generate the requested text. Requests are sent using a setting that restricts routing to providers that state they do not use content for training or routine retention. This is not a zero-retention guarantee; limited retention may occur for abuse prevention, security, billing, or legal compliance.” The screen provides “Allow and Continue” and “Don’t Allow” actions. Choosing “Don’t Allow” sends no content to OpenRouter or Meta and leaves writing mode disabled; the player and server-based narration remain available.
- Narration upload screen, before every server-based narration order, which states: “Upload this text to OWN PLACE LLC’s service hosted by Modal in the United States for server-based narration. It will not be sent to OpenRouter or Meta.”
- Delivery and server-retention notice, before your first order and again on the AI Studio purchase screen, which states: “After delivery, Talefall saves the book on this device and, if iCloud is available and the save succeeds, in your private iCloud storage. OWN PLACE LLC deletes its server copy after the final chapter has been saved on this device and cannot restore it. If iCloud is unavailable or full, export your own backup before deleting the App.” Because the server copy is deleted, a delivered book cannot be downloaded from our service again (Section 8).
Before every order — in both modes — the App shows the statement “I confirm that this order does not contain information about an identifiable real person, including me, and does not contain health, biometric, genetic, precise-location, financial-account, or other sensitive personal data” with the button “Confirm and Continue.” If you indicate instead that the order does contain such information, the App refuses the order and nothing is sent to our server; for narration, use the on-device voice. No screen in the App asks for, and no tap is treated as, consent to process health or other sensitive personal data.
We record the version and time of each acceptance and permission, and the version and time of the per-order confirmation and of the narration upload confirmation with the order. If we change the model provider or materially change these Terms or the Privacy Policy, the App asks again before the next order. You may withdraw the AI-provider permission at any time in Settings → Privacy; the Service will then not accept new writing-mode orders until you grant permission again. Withdrawing AI-provider permission disables writing mode only. Server-based narration remains available subject to its separate upload confirmation.
5.2 No guarantees about the output; accuracy note; age requirement. AI-generated text is produced by a statistical model. It may be inaccurate, incomplete, repetitive, biased, offensive, or otherwise unsuitable, may differ from what you asked for, may be shorter or longer than ordered, and may resemble existing works. Narrated audio may contain mispronunciations. Do not rely on generated content for factual accuracy. Writing-mode output is intended as fictional entertainment and may be inaccurate or fabricated. Server-based narration reproduces the text you submit and may be fiction or non-fiction. Writing-mode output is not professional advice. Server-based narration does not verify, endorse, or convert the submitted text into advice from OWN PLACE LLC. Do not use generated content as a substitute for a licensed professional (medical, legal, financial, or otherwise). You are responsible for reviewing generated content before relying on it or sharing it. Because we do not review requests or generated content before it reaches you, AI Studio is not intended for minors, and you must be at least 18 (or the age of majority in your jurisdiction, if older) to use AI Studio — see the App-wide age requirement in Section 2.
5.3 Your requests. You are solely responsible for the descriptions and text you submit. AI Studio’s writing mode accepts orders for fictional works only; the server-based narration mode accepts only text you are entitled to submit (Section 5.8). You must not submit requests or text that:
(a) are unlawful or would result in unlawful content, including content that sexualizes minors, makes credible threats, promotes terrorism or extremist recruitment, facilitates human trafficking, provides instructions for self-harm or serious wrongdoing, harasses, or defames; (b) are pornographic or graphically explicit sexual content, sexual services, sexual exploitation, non-consensual sexual content, or fetish content intended primarily for sexual arousal — all of which are prohibited; mature themes handled as part of an adult work of fiction are not, within the limits of the AI Safety and Content Policy; (c) in writing mode, describe, depict, or are about a real, identifiable person — including yourself — or, in either mode, are intended to impersonate a real person or organization; (d) contain personal data, health information, or other sensitive information about an identifiable real person, including you, or personal information about other people that you have no right to share; (e) infringe another person’s copyright, trademark, privacy, or publicity rights — including requests to reproduce, continue, or closely imitate a specific copyrighted work or a living author’s identifiable style with intent to pass it off; (f) seek medical, legal, financial, or other professional advice, or are intended to produce content that will be presented as such advice without the involvement of a licensed professional; (g) contain malware, prompt-injection, or attempts to extract our system instructions, provider keys, or other users’ data; or (h) are designed to circumvent hours, limits, territorial restrictions, or content safeguards.
The full list of prohibited uses is in our AI Safety and Content Policy. Our automated safety controls may decline a request or stop an order; the model provider may apply its own safeguards under its current service configuration, and we do not rely on those safeguards as a substitute for our controls. A declined request consumes no hours, and an order stopped by a safety control is not charged.
5.4 Safety controls, reporting, and enforcement. We use automated input and output safety controls designed to block prohibited content, including sexual content involving minors, pornographic content, credible threats, terrorist or extremist material, trafficking, self-harm instructions, instructions facilitating serious wrongdoing, targeted harassment, and unlawful exploitation. Report content submits the report directly through the App. If submission fails, the App offers email as a fallback method. We review and respond to all content reports in a timely manner. Reports involving child exploitation, credible threats, or imminent harm receive immediate priority. If an investigation requires additional time, we inform the reporter through the available reporting channel. “A content report may include the excerpt or chapter you choose to submit for review; reported content is retained separately under the report-retention period.” Where server content appears unlawful we restrict access to it immediately pending review. When we obtain actual knowledge of facts or circumstances triggering 18 U.S.C. §2258A, including apparent covered child sexual exploitation, child sex trafficking, or online enticement, we report to NCMEC as soon as reasonably possible. We preserve report materials for one year after submission and longer where legally required, using the legally required security safeguards. We may remove the server copy of a book, refuse further orders, and block a subscription identifier from further use for serious or repeated violations. If your subscription identifier is blocked, you may appeal by email within 30 days and we will answer in writing within 30 days; the appeal procedure is in the AI Safety and Content Policy. Blocking for a violation of this Section does not entitle you to a refund from us for hours already used, without prejudice to any refund Apple grants or that applicable law requires.
5.5 Ownership of generated books. As between you and OWN PLACE LLC, we assign to you any right, title, and interest that we may lawfully hold in the generated text and delivered narration, excluding our models, software, prompts, trademarks, narrator identity, and other underlying technology, and you may use the generated text and narration for any lawful purpose, including commercially. We claim no ownership of your requests. We do not promise that the output is copyrightable, unique, non-infringing, or eligible for exclusive ownership: laws in many countries grant limited or no copyright to purely AI-generated works, and the same or similar text may be generated for other users. You remain responsible for ensuring that your use of the generated content does not infringe third parties’ rights.
5.6 Our reserved rights. Our rights and the rights of our licensors in the narrator software, model components, voice assets, prompts, writer program, and service infrastructure are reserved. No license to train, extract, clone, or redistribute those components is granted, and you may not use delivered narration to train or clone a voice model.
5.7 Our license to your content. You grant OWN PLACE LLC a non-exclusive, worldwide, royalty-free license to store, copy, process, transmit, and narrate your requests, the text you submit for narration, and the generated books, solely to provide the Service to you until delivery is confirmed, to operate the safety controls in Section 5.4, to enforce these Terms, and as required by law. That license ends for a given order when we delete our server copy under Section 8. “We do not retain order content after confirmed delivery, except content you separately submit in a report or support request and content that law requires us to preserve.” We do not use your content to train models or for advertising.
5.8 Text you submit for narration. The server-based narration mode may process only text that you are legally entitled to submit and that does not contain personal or consumer health data about an identifiable real person, including you. Use the on-device voice for text containing such data. When you ask the Service to narrate a text book you already have, you represent that you own the text or have the right to have it reproduced as audio for your personal use, and you give the per-order confirmation in Section 5.1. The narrator model is operated by OWN PLACE LLC in a private container hosted by Modal. The text is processed by Modal as our infrastructure provider but is not sent to OpenRouter, Meta, or another model provider. Do not submit text you are not entitled to copy. See also Section 6.
6. User Content, Legality, Anti-Piracy, and Copyright Complaints
The App allows you to import files from the Files app and to upload files from your computer over your local Wi-Fi network, and the Service allows you to submit text for narration. You are solely and fully responsible for the files and text you import, upload, submit, store, and play, and for the legality of doing so.
You represent and warrant that, for every file or text you add, you own it or otherwise have all necessary rights, licenses, and permissions. You must not use the App or the Service to import, store, reproduce, narrate, or distribute any material that infringes any copyright, trademark, or other intellectual-property or proprietary right, or that you are not legally entitled to possess. Using pirated, unlicensed, or unlawfully obtained content is strictly prohibited.
The App is designed to display catalog content identified by the applicable third-party service (LibriVox, Internet Archive, Project Gutenberg) as public-domain or otherwise lawfully available. We do not independently guarantee the copyright status of every work in every jurisdiction. You are responsible for confirming that downloading and listening to a given work is lawful where you are located.
Copyright complaints. We respect intellectual-property rights. Content in the built-in catalogs is hosted by third parties, and complaints about a catalog work should ordinarily be directed to the service that hosts it.

We will review the complaint and may stop an active order, remove or disable access to material still held by us, restrict the associated subscription, or take other appropriate action. AI Studio content is private and is ordinarily deleted after confirmed delivery, so the material may no longer be present on our server when a complaint is received. We reserve the right to remove, hide, or disable access to any catalog entry, link, generated book, or other disputed material, and to suspend the Service subscription of repeat infringers, with or without prior notice.
This is a voluntary copyright-complaints channel. The Copyright Contact is not a designated agent registered with the U.S. Copyright Office under 17 U.S.C. § 512(c)(2).
7. Acceptable Use; Export and Sanctions
You agree not to: (a) use the App or the Service for any unlawful purpose or in violation of these Terms; (b) reverse-engineer, decompile, or disassemble the App except to the extent expressly permitted by law; (c) extract the App’s service token, forge or replay Apple transaction records, or otherwise access the Service other than through the unmodified App; (d) interfere with or disrupt the App, the Service, or the local network features; (e) use the local Wi-Fi upload server to transmit malware or to access devices or networks without authorization; (f) resell, sublicense, or share your subscription or its hours, or use automation to place orders; (g) use the App or the Service to infringe the rights of others; or (h) circumvent the territorial restrictions in Section 4.9.
Export and sanctions. You may not use or export the Service in violation of applicable U.S. export-control or sanctions laws. You may not purchase or use AI Studio if you are a blocked or sanctioned person, are owned 50 percent or more in the aggregate by one or more blocked persons, are acting for or on behalf of such a person, are located in an embargoed country or region, or if the transaction would otherwise be prohibited under U.S. sanctions or export-control laws. We may refuse or suspend access and block or report property as required by law. Embargoed regions include the Crimea region and the so-called Donetsk People’s Republic and Luhansk People’s Republic regions of Ukraine, as defined by OFAC, and any other region later designated as a Covered Region; our service blocks requests from those regions separately from the country check in Section 4.9. GeoIP is a territorial control and does not by itself establish sanctions eligibility.
Wi-Fi upload safety. The Wi-Fi upload feature runs a temporary local web server on your device protected only by a session token and using unencrypted HTTP on your local network. Use it only on a trusted private Wi-Fi network (never on public or shared networks), and turn the server off when you are done. You use this feature at your own risk.
8. Availability, Changes, and Termination of the Service
The Service is provided on a best-effort basis. We do not guarantee that it will be available at any particular time, that an order will complete within any particular time, or that it will be free of errors. Generation depends on third-party model providers and cloud infrastructure that we do not control; their outages, price changes, or policy changes may delay, degrade, or prevent orders. An order that cannot be completed is not charged (Section 4.2).
Changes. We may change the Service — including the models, narrator voice, order length limits, and the hours included in future billing periods — and may suspend or discontinue it, subject to Section 4.10: material adverse changes apply only to future billing periods after reasonable advance notice, and never reduce what you already paid for in the current period.
Discontinuation. If we discontinue AI Studio, we will give notice in the App and on our website at least 30 days in advance where practicable, will stop charging renewals, will provide a reasonable period to use remaining monthly and extra hours, and — where use is impossible — will assist affected users in requesting an appropriate refund through Apple. Books already delivered to your device will keep working in the player.
No post-delivery server retention. The order text, the generated chapters, the title, and the audio are held on Modal as temporary working storage only for as long as the order is being carried out and delivered: the content is encrypted, subject to an application-level time-to-live, and excluded from OWN PLACE LLC’s application logs and crash reports. We do not create separate content backups. Processor backup copies, if any, are handled as described in our Privacy Policy. Modal may retain Function inputs and outputs for up to seven days under its infrastructure retention policy, independently of deletion from our application storage. The one-day period applies to application and container logs only. “Delivery is confirmed only after the App has durably saved every chapter on the device.” Immediately after delivery of the final chapter is confirmed, OWN PLACE LLC deletes its server copy of the text and the audio. After that, OWN PLACE LLC cannot recover or re-deliver the book from its server; the App may still restore the user’s own saved iCloud copy; this is disclosed before your first order and on the AI Studio purchase screen (Section 5.1). “If full delivery is not confirmed within seven days after the Service accepts the order, we treat the order as failed, stop further processing, delete all server-side order content, and automatically restore all hours reserved or charged for that order. Chapters already saved on your device remain available.” “We do not retain order content after confirmed delivery, except content you separately submit in a report or support request and content that law requires us to preserve.” This applies regardless of whether your subscription is still active.
Your own copy. “After delivery, Talefall saves the book on this device and, if iCloud is available and the save succeeds, in your private iCloud storage. OWN PLACE LLC deletes its server copy after the final chapter has been saved on this device and cannot restore it. If iCloud is unavailable or full, export your own backup before deleting the App.” The App stores the copy through Apple’s iCloud service under your Apple account. OWN PLACE LLC does not access or control that copy, and it is not a “cloud storage” benefit of the subscription. Access to that saved copy does not depend on an active subscription. You can also export a copy at any time with Export to Files. A privacy deletion request addressed to us does not delete your iCloud copy; deleting a book in the App offers to remove the local and the iCloud copy.
Suspension and termination of the Service. We may suspend or terminate your access to the Service, and refuse further orders, if we reasonably believe you have violated Sections 4.9, 5, 6, or 7, attempted to circumvent limits, or obtained a refund for hours already used. Suspension or termination of AI Studio does not terminate your separately purchased player license. The App license may be terminated only as provided by the Apple Standard EULA or for a material breach relating to the App itself. Sections 4.2–4.3 (as to restored or recorded hours), 5.2, 5.5–5.7, 6, 9–13, and 15 survive termination.
9. Third-Party Services
The App connects to third-party services you choose to use (Apple, LibriVox, Internet Archive, Project Gutenberg, GitHub Pages for our configuration file). Your use of those independent services is governed by their own terms and privacy policies; we are not responsible for their content, and their availability is not guaranteed.
The Service relies on Modal Labs (hosting), OpenRouter, and the model provider reached through it. Modal and OpenRouter are bound by written data-processing terms covering confidentiality, security, documented instructions, subprocessors, rights requests, deletion, and incident notification. Meta acts as OpenRouter’s subprocessor under OpenRouter’s applicable flow-down obligations. Details are in the Privacy Policy, Section 6.3. OWN PLACE LLC remains responsible for its selection and use of these service providers; we do not, however, guarantee their continued availability or the behaviour of any particular model.
10. Disclaimer of Warranties (“AS IS”)
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP, THE SERVICE, AND ALL GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND QUIET ENJOYMENT. WE DO NOT WARRANT THAT THE APP OR THE SERVICE WILL BE UNINTERRUPTED, TIMELY, ERROR-FREE, OR SECURE, THAT GENERATED CONTENT WILL BE ACCURATE, ORIGINAL, LAWFUL, OR SUITABLE FOR ANY PURPOSE, OR THAT ANY THIRD-PARTY CATALOG OR MODEL PROVIDER WILL REMAIN AVAILABLE. THIS SECTION DOES NOT LIMIT THE STATUTORY CONFORMITY REMEDIES REFERRED TO IN SECTIONS 4.1, 4.5, AND 11.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL OWN PLACE LLC OR ITS MEMBERS, OFFICERS, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR CONTENT (INCLUDING GENERATED BOOKS), ARISING OUT OF OR RELATING TO THE APP, THE SERVICE, OR GENERATED CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU ACTUALLY PAID TO US THROUGH APPLE FOR THE APP AND THE SERVICE IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.
These limitations do not apply to liability that cannot lawfully be limited, including liability for fraud, willful misconduct, gross negligence where non-waivable, death or personal injury caused by negligence, or violation of non-waivable privacy or consumer rights. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits or excludes any liability or consumer right that cannot be limited or excluded under applicable law.
Without limiting Section 10, we specifically do not guarantee: the continued availability of any third-party service or model; the availability of any particular catalog work; the accuracy of third-party metadata; the preservation of locally stored files after the App is deleted or after a device failure; or the preservation of server copies of generated books beyond what Section 8 and the Privacy Policy describe. We cannot restore deleted local files, and you are responsible for your own backups.
12. Indemnification
To the extent permitted by law, you will indemnify OWN PLACE LLC against a third-party claim directly caused by your knowing unlawful commercial use of submitted or generated content or your material breach of Sections 5–7. We will promptly notify you and allow reasonable participation in the defense. This clause does not require you to indemnify us for our negligence, misconduct, or legal violations.
13. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-laws rules. The exclusive venue for any dispute is the state and federal courts located in the State of Washington, and you consent to their personal jurisdiction, except where applicable consumer- protection law gives you the right to bring a claim where you live. Before filing a claim, please email contact@ownplace.net; most issues can be resolved informally within 30 days.
14. Apple as Third-Party Beneficiary
You acknowledge that these Terms are between you and OWN PLACE LLC only, not Apple; that OWN PLACE LLC, not Apple, is solely responsible for the App, the Service, and their content, maintenance, support, and any claims relating to them (including product-liability, consumer-protection, and intellectual-property claims); that Apple has no obligation to provide maintenance or support for the App; and that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these Terms against you. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
15. Notices, Changes to These Terms, and General Provisions
Changes. We may modify these Terms from time to time. We will update the “Effective Date” and post the revised Terms at their public URL; previous versions remain available on request. For changes affecting AI Studio we will also show a notice in the App. Material changes do not reduce benefits already purchased for the current period. We will request affirmative acceptance where required by law or where a change materially expands data processing or user obligations — in that case the App asks you to accept the new version before your next AI Studio order. For other changes, your continued use of the App or the Service after the change takes effect constitutes acceptance; if you do not agree, stop using the App and cancel any subscription before the next renewal.
Notices. Notices to you may be given in the App or on our website; notices to us go to contact@ownplace.net or to 7707 NE 141st St, Kirkland, WA 98034-5321.
Assignment; waiver; force majeure. We may assign these Terms in connection with a merger, reorganization, or sale of the Service, subject to applicable law. You may not assign these Terms or your subscription. A failure to enforce a provision is not a waiver. Neither party is liable for delay caused by events beyond its reasonable control, but this does not excuse refunds or other non-waivable consumer remedies.
Language. These Terms are written in English. We provide key purchase, permission, safety, and privacy disclosures in the App’s supported languages (English, Russian, and Spanish). If a translation conflicts with the English version, the English version controls; mandatory consumer rights under the law of your residence are not limited by this provision.
Severability; entire agreement. If any provision of these Terms is held unenforceable, the rest remain in effect. These Terms, the Privacy Policy, the Consumer Health Data Privacy Policy, the AI Safety and Content Policy, and the Apple Standard EULA are the entire agreement between you and us regarding the App and the Service.
