Effective Date: September 7, 2026. Effective on the first public release of the App.
These Terms of Use (the “Terms”) are a binding agreement between you and OWN PLACE LLC, 7707 NE 141st St, Kirkland, WA 98034-5321, State of Washington, USA (“OWN PLACE LLC,” “we,” “us,” or “our”), governing your use of the Own Place application (published on the App Store as “OwnPlace”) and the platform reached through it (together, the “App” or the “Service”).
By creating an account or using the App you accept these Terms. If you do not accept them, do not use the App.
These Terms supplement, and do not replace or reduce, the Apple Standard EULA described in our EULA. How we handle data is described in our Privacy Policy.
These Terms are published in English, Russian, and Spanish. The English text is the reference version.
1. What Own Place Is — and What It Is Not
Own Place is a marketplace. It connects two kinds of users:
- a professional (in the App, a “specialist” or “master”) — an independent person or business that offers services, publishes a profile, a list of services with prices and durations, working locations, and a schedule; and
- a client — a person who finds a professional, books a time slot, messages the professional in the App, pays for the service, and may leave a review.
OWN PLACE LLC is not a party to the agreement between a professional and a client. We do not provide the services listed in the App. We do not employ, supervise, direct, or control professionals. We do not screen, verify, guarantee, or endorse a professional’s identity, qualifications, licenses, insurance, or background, unless something on that professional’s profile explicitly says that we do.
You engage a professional at your own discretion and risk. Do your own checking before booking a service. A professional is responsible for holding whatever license, permit, registration, or insurance the law of their state and city requires for the services they offer.
The App is offered in the United States only, and its interface is in English and Russian.
2. Eligibility and Age
The App is intended for users 13 years of age or older. By creating an account you represent that you meet that requirement. Users between 13 and 17 may use the App only with the consent and involvement of a parent or legal guardian, who accepts these Terms on the minor’s behalf. We may terminate any account that does not meet this requirement.
To register as a professional and receive payouts, you must additionally be of legal age to enter into a contract in your state and to open a Stripe Connect account.

3. Your Account
You sign in through Sign in with Apple or Sign in with Google. You are responsible for keeping your device and your sign-in credentials secure, and for everything done through your account. Use of the App on a jailbroken or rooted device is not recommended and may result in restricted access.
You may delete your account at any time from inside the App (Profile settings → Delete Account). What deletion does, and what survives it, is described in Section 11 of the Privacy Policy.

4. Bookings
A booking made through the App is an agreement between the client and the professional, not with us. The professional sets the services, prices, duration, locations, and available time slots. Booking a slot reserves that slot in the professional’s schedule.
A booking moves through statuses in the App — booked by the client, booked by the professional, confirmed by the professional, completed, or cancelled by either side. Either side may report a problem with a completed booking; see Section 6.
Both sides are expected to show up on time, to communicate changes through the App, and to treat the other person decently.
5. Payments
All card payments are processed by Stripe, Inc. OWN PLACE LLC never receives, sees, or stores your card number, security code, or bank account details, and the App contains no payment SDK at all — every payment operation runs on our server through Stripe’s API.
How a paid booking works:
- When you book, your payment method is saved with Stripe.
- Ahead of the appointment, our system places a hold (an authorization, not a charge) on your payment method for a deposit. The deposit is a percentage of the booking price, and that percentage is set by the professional in their own profile settings. Holds are placed up to 96 hours before the appointment starts; a failed attempt is retried for up to 48 hours.
- After the appointment, if neither side reports a problem, the hold is captured automatically once the review window has passed — currently 12 hours after the appointment ends.
- Money owed to the professional is transferred to that professional’s own Stripe Connect (Express) account. The professional is the merchant of record for the service.
Cancellation. If a booking is cancelled before the hold is captured, the hold is released and you are not charged. If the professional’s cancellation policy allows it, a part of the held amount can be captured instead — for example as a late-cancellation or no-show fee. Cancellation windows and fees are set by the individual professional.
Refunds after a charge has been captured. Raise the issue with the professional first. If that does not resolve it, write to contact@ownplace.net.

6. Complaints About a Booking, and Automatic Resolution
Either side may file a complaint about a completed booking from inside the App. Filing a complaint opens a dispute on the payment and notifies the other side.
If the other side does not respond within 4 hours, the dispute resolves automatically:
- a complaint opened by the client → the hold is released (no charge);
- a complaint opened by the professional → the hold is captured (the professional is paid).
Because this window is short and the outcome is automatic, respond promptly to any complaint notification. This process concerns the payment only; it is not an adjudication of who was right, and it does not limit either side’s rights under Section 15.
7. Professional Subscription
Operating as a professional requires a monthly auto-renewable subscription, purchased through the App Store (iOS) or Google Play (Android). The subscription unlocks the professional role: publishing a profile and services, running a schedule, and receiving bookings.
- Introductory free month. A first-month-free introductory offer is configured for the subscription. Eligibility for an introductory offer is determined by Apple or Google, not by us.
- Auto-renewal. The subscription renews automatically for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
- Managing and cancelling. Manage or cancel in your App Store account settings (iOS: Settings → your name → Subscriptions) or in Google Play → Subscriptions. Deleting the App does not cancel a subscription.
- Price and billing. The price is the localized price the store shows you immediately before purchase. Any price mentioned elsewhere is illustrative and may be out of date. Charges, receipts, refunds, and purchase history are handled by Apple or Google under their own policies — for iOS, see https://reportaproblem.apple.com.
- Price changes. We will give you at least 30 days’ notice before a change to the recurring subscription fee takes effect, and the store will ask for your consent where its rules require it.
If your subscription lapses, your professional profile stops accepting new
bookings. 8. User Content and Conduct
“User content” is everything you put into the App: your profile, bio, service descriptions and photos, addresses, schedule, chat messages, booking notes, reviews, and complaint texts.
You are responsible for your user content. You keep ownership of it. You grant OWN PLACE LLC a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display it solely to operate the Service — showing your profile to clients, delivering your messages, publishing your reviews.
You must not:
- post anything unlawful, fraudulent, defamatory, harassing, hateful, obscene, or sexually explicit, or anything that threatens or endangers another person;
- offer or solicit anything illegal, or any service you are not licensed to provide;
- impersonate another person, or misrepresent your qualifications, licenses, or identity;
- post someone else’s personal information without their permission, or enter more information about a manual contact than the booking needs;
- post health information about yourself or anyone else (see Section 13 of the Privacy Policy);
- write a review you did not earn — a fake review, a review traded for payment, or a review of yourself or a competitor;
- send unsolicited advertising, spam, or bulk messages;
- take a booking off the platform to avoid fees, misuse the payment hold, or otherwise defraud another user or us;
- scrape, reverse-engineer, overload, or interfere with the Service;
- use the App from a country subject to United States embargoes or sanctions, or if you are on a United States restricted-party list.
Reviews must describe an actual experience of an actual booking. We may remove content that violates these Terms and may suspend or terminate an account that does.
9. Reporting Abuse and Blocking
If another user harasses you, sends abusive content, or violates these Terms, write to contact@ownplace.net with the details. We review reports and may warn, suspend, or terminate an account.

10. Third-Party Services
The Service relies on third parties, each under its own terms: Apple and Google Play (distribution and subscription billing), Stripe (payments and payouts; using Stripe Connect requires accepting Stripe’s own agreement), RevenueCat (subscription state), Supabase and Google/Firebase (hosting, storage, push notifications), and Google Places (address autocomplete). We are not responsible for those services’ acts or omissions.
11. Availability, Changes, and Termination
We may change, suspend, or discontinue any part of the Service, and we may impose limits, at any time. We aim to give notice of material changes, but we do not guarantee uninterrupted or error-free operation.
You may stop using the App at any time and delete your account (Section 3).
We may suspend or terminate your account, with or without notice, if you breach these Terms, if we reasonably suspect fraud or abuse, or if we are required to by law. If your account is terminated, upcoming bookings may be cancelled and holds released; payouts already earned remain payable.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We specifically make no warranty about, and accept no responsibility for, the services professionals provide, their conduct, their qualifications, their licensing, the accuracy of anything they post, or anything that happens at an appointment. The same applies to the conduct of clients.
Some states do not allow the exclusion of certain warranties; in that case the exclusions above apply to the fullest extent permitted by law.
13. Limitation of Liability
To the fullest extent permitted by law, OWN PLACE LLC and its members, managers, and employees will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or relating to the Service, whether based in contract, tort, or any other theory, even if we have been advised of the possibility.
Our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid to OWN PLACE LLC in the twelve months before the event giving rise to the claim, or (b) one hundred United States dollars (US$100).
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Indemnification
You agree to defend, indemnify, and hold harmless OWN PLACE LLC from and against any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, your user content, a service you provided or received, or your breach of these Terms or of any law.
15. Disputes: Informal Resolution, Arbitration, Class-Action Waiver
15.1 Talk to us first. Before starting a formal proceeding, write to contact@ownplace.net describing the problem. We will try in good faith to resolve it within 30 days.
15.2 Binding individual arbitration. If we cannot resolve it informally, you and OWN PLACE LLC agree that any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will take place in King County, Washington, or by telephone or videoconference. The Federal Arbitration Act governs this section.
15.3 Class-action waiver. YOU AND OWN PLACE LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
15.4 Your right to opt out. You may opt out of Sections 15.2 and 15.3 by sending written notice to contact@ownplace.net within 30 days of first accepting these Terms. Opting out does not affect anything else in these Terms.
15.5 Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief for infringement or misuse of intellectual property.
16. Governing Law and Venue
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules. For any dispute not subject to arbitration, you and we consent to the exclusive jurisdiction of the state and federal courts located in King County, Washington.
17. Apple and Google
These Terms are between you and OWN PLACE LLC only, not with Apple or Google. OWN PLACE LLC, not Apple, is responsible for the App and its content, and for any maintenance and support; Apple has no obligation to furnish either. Apple is not responsible for any product warranty, product-liability claim, or third-party intellectual-property claim relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. For the Android version, the equivalent applies to Google under Google Play’s terms.
18. Changes to These Terms; General
We may update these Terms. We will update the effective date at the top and publish the new version at this address before it takes effect. Continued use after that means you accept the update; if you do not, stop using the App and delete your account.
If a provision is held unenforceable, the rest stays in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them to a successor in a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy and the EULA, are the entire agreement between you and us about the Service.
